The Lawsuit Reform Alliance of New York is proud to partner with Building Industry Employers on legal issues affecting New York builders.

One lawsuit can sink a small contractor, and builders of all sizes must pay outsized insurance costs to do business in New York. Sadly, much of the litigation and high insurance costs facing New York builders is due to a law that only exists in New York. Labor Law 240, known as the Scaffold Law, applies absolute liability to builders and property for any gravity-related injury, even if the builder was not primarily at fault.

The Scaffold Law costs taxpayers $785 million a year and costs builders billions in higher insurance and litigation costs. The Lawsuit Reform Alliance of New York and the Building Industry Employers are working together to change the current statute to adopt a comparative negligence standard and put New York in line with every other state.
